Downloading, installing, launching, activating, testing or using DERCAR ID CUT means accepting this License Agreement.

For website downloads, the term “DERCAR ID Cut panel” applies to the relevant downloadable DERCAR ID CUT components: Adobe Illustrator, CorelDRAW and DERCAR ID Cut Operator, unless separate written terms state otherwise.
Governing Law and Territorial Scope (Choice of Law & Venue) For users located in the Russian Federation, the CIS states, and the Republic of Türkiye: This Agreement, including any matters relating to its formation, interpretation, performance, validity, termination, breach, consequences of breach, as well as any non-contractual obligations directly or indirectly connected with the use of the DERCAR ID Cut panel, shall be governed by and construed in accordance with the substantive laws of the Russian Federation, without regard to conflict-of-law principles. Any disputes, controversies, claims, demands, or other conflicts arising out of or in connection with this Agreement, including disputes concerning its existence, validity, formation, breach, or termination, shall be submitted to the competent state commercial court at the registered place of business of the rights holder, unless otherwise required by mandatory provisions of applicable law. For users in the European Union (EU) and the United Kingdom: These terms shall apply solely to the extent that they do not conflict with mandatory provisions of consumer protection law, digital content law, digital services law, mandatory updates, conformity remedies, price reduction rights, termination rights, minimum quality guarantees, and any other non-waivable rights granted to the user under the laws of their country of habitual residence, including, without limitation, Directive (EU) 2019/770 and the national legislation implementing it. In the event of any inconsistency between this Agreement and the mandatory standards of the relevant jurisdiction, such mandatory provisions shall prevail. For users in the United States and all other jurisdictions outside the EU and UK: This software is provided on an “AS IS” and “AS AVAILABLE” basis, to the maximum extent permitted by applicable law, without any express, implied, statutory, or other warranties whatsoever, including, without limitation, warranties of merchantability, fitness for a particular purpose, uninterrupted operation, accuracy of results, commercial usefulness, or non-infringement. Any claim arising out of or relating to the product must be brought within 1 (one) year after the claim arose, unless a longer period is required by non-waivable law. The user irrevocably acknowledges that all use of the DERCAR ID Cut panel, including its algorithms, generation mechanisms, Adobe Illustrator interaction modules, HPGL, DT, CuttingLink, RIP environments, and any internal or external data, is undertaken solely at the user’s own risk. Under no circumstances shall the rights holder, developer, integrator, reseller, or any affiliated parties be liable for any direct, indirect, incidental, consequential, exemplary, punitive, special, commercial, production-related, or other damages, including, without limitation, wasted materials, incorrect cutting, repeat production, downtime, lost profits, lost business opportunities, missed customer deadlines, workflow disruption, third-party software license loss, corrupted files, incorrect scale generation, cut displacement, operator error, or incompatibility with Adobe Illustrator versions, drivers, operating systems, RIP software, CuttingLink, networking, storage systems, or user-defined settings. The user agrees that all recommendations, parameter values, tolerances, curve precision values, mark geometries, ID ranges, duplication logic, and any other functional parameters displayed by the interface are provided solely for reference and tooling purposes and must be independently validated through competent engineering review before any production use. The rights holder has no obligation to preserve backward compatibility, uninterrupted service, unchanged internal formats, stable integration behavior, or continued support for any licensing mechanism, activation method, generation limit, protection scheme, or third-party interaction in future releases. The user expressly agrees that the rights holder may issue automatic, background, mandatory, recommended, manual, or silent updates, fixes, patches, and new versions, including updates that modify, restrict, disable, reallocate, or remove features, algorithms, ID ranges, licensing methods, activation flows, generation limits, protection systems, interface components, internal data formats, and integration methods with Adobe Illustrator, CuttingLink, RIP environments, and third-party systems. To the fullest extent permitted by law, aggregate liability shall in all cases be limited to the amount actually paid by the user for the applicable license. All third-party names and product references, including Adobe, Adobe Illustrator, Mimaki, CuttingLink, and hardware model names, remain the trademarks or registered trademarks of their respective owners and do not imply sponsorship, endorsement, affiliation, or partnership. The mere act of installing, launching, activating, testing, or using the panel constitutes full acceptance of these terms. The user is expressly prohibited from using the DERCAR ID Cut panel or any derivative outputs in weapons systems, military avionics, military drones, nuclear reactors, life-support systems, hazardous industrial facilities, autonomous transport control systems, or any environment where failure could result in death, serious bodily injury, environmental harm, large-scale property loss, industrial accidents, or armed conflict. Such use constitutes a material breach, fully releases the rights holder from liability, and obligates the user to indemnify the rights holder for all reasonable legal fees, expert costs, and court expenses. The user further acknowledges that the code, ID generation algorithms, licensing and verification methods, data structures, and license-server communication protocols constitute confidential know-how and protected technology. Any decompilation, disassembly, tracing, memory dumping, bytecode modification, license-response emulation, derivative work creation, or extraction or imitation of operational logic is strictly prohibited. INDEMNIFICATION. The user agrees to defend, indemnify, and hold harmless the rights holder, its affiliates, officers, agents, resellers, and licensors from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to the user’s misuse of the software, breach of this Agreement, prohibited-system deployment, export violations, sanctions violations, infringement of third-party rights, or unlawful production activity. CLASS ACTION WAIVER. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE USER AGREES THAT ANY CLAIM SHALL BE BROUGHT SOLELY IN THE USER’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION. JURY TRIAL WAIVER. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE USER KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE. EXPORT CONTROL AND SANCTIONS COMPLIANCE. The user represents and warrants that the software will not be exported, re-exported, transferred, released, or otherwise made available, directly or indirectly, in violation of any applicable U.S. export control laws, regulations, embargoes, or sanctions programs, including without limitation regulations administered by the U.S. Department of Commerce, the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC), or any similar authority. The user further represents that neither the user nor any beneficial owner, operator, or end customer is a sanctioned person, restricted party, denied party, embargoed jurisdiction, or prohibited military end user. Any successful single execution, correct displayed value, or correct test-mode ID generation shall not constitute any guarantee of repeatability in subsequent runs on different equipment, driver settings, or operating conditions. Before each production run, the user must complete a full verification cycle on a minimum-area test fragment. To the fullest extent permitted by law, except where such exclusion is prohibited, the rights holder shall not be liable for physical damage to cutting tools, cutting tables, vacuum systems, laser tubes, guides, spindles, knives, dies, conveyors, CNC systems, computers, servers, network equipment, UPS systems, electrical generators, fire suppression systems, or for injuries, fatalities, fires, short circuits, or production shutdowns arising from software defects, infinite loops, memory leaks, freezes, false triggers, or failure to respond to stop commands.
